Summary of the key law and content changes on ComplyWith (update as of 7 September 2018)

What laws have changed?

Most recent law changes affect the tertiary education sector, and another change affects local authorities.

NZQA rule changes

On 22 and 23 August a number of changes were made to the NZQA rules. These included:

  • Two new Rules:
    • NZQF Programme Approval and Accreditation Rules
    • Private Training Establishment Registration Rules
  • Important changes to the other NZQA Rules including:
    • institutions (other than universities) must keep student assessment materials (or copies) for at least 12 months (PTEs already have this obligation)
    • if a programme leading to a qualification isn’t taught in English, the certificate must state the language of instruction
    • new requirements to maintain NZQA approval of an industry training micro-credential (or a training scheme with micro-credential approval)
    • new monitoring requirements for institutions (other than universities) to maintain training scheme and micro-credential approval

Local authorities

The Local Government Members (2018/19) (Local Authorities) Determination 2018 was made on 26 July 2018 and was deemed to apply from 1 July 2018. It sets out the remuneration, allowances, and hearing fees that local authorities can pay elected members.

What else has changed?

What’s coming up?

Some important law changes coming up in the next few months are:

  • The requirements in the Education Act for PTEs to allow domestic students to withdraw from a programme or training scheme of less than 3 months and to pay a refund specified by NZQA apply to students enrolled from 30 September 2018.
  • The new Customs and Excise Act 2018 comes into force on 1 October 2018.
  • A range of standards for dealing with animals comes into force of 1 October 2018 under the Animal Welfare (Care and Procedures) Regulations.
